Can I put my spouse or my kids on payroll?

Yes, you can put your spouse or children on payroll. Family payroll is a legitimate practice when done correctly.

The requirements are straightforward. The family member must do real work for the business. This means actual tasks that benefit the company, whether that is administrative help, cleaning the office, answering phones, or any other genuine duties. The work cannot be made up or exaggerated just to create a payroll entry.

The pay must be reasonable for the work performed. What you pay your spouse or child should reflect what you would pay an unrelated employee for the same tasks. Paying your teenager $50 an hour to sweep the floor would raise questions. Paying them a fair hourly rate for real hours worked is fine.

From a payroll standpoint, family members are processed like any other employee. They fill out a W-4. You withhold taxes based on their elections. You deposit payroll taxes on schedule. They receive a W-2 at year end. There are some differences in how certain taxes apply depending on the family relationship and the age of children working for a parent-owned business, but the fundamental requirement is that everything runs through the payroll system properly.
